1. Introduction

Welcome to Asfaly. These Terms of Service (ToS) govern the use of our post-mortem digital vault service accessible via the website https://www.asfaly.com and the application https://app.asfaly.com.

By using our services, you unconditionally accept these ToS. If you do not accept these terms, please do not use our services.

2. Acceptance of terms

Access and use of Asfaly services implies full and complete acceptance of these ToS. These terms may be modified at any time. It is your responsibility to consult them regularly.

3. Service description

Asfaly is a digital vault service that allows you to:

  • Securely store your passwords and credentials
  • Designate beneficiaries who can access your data after your death
  • Organize the transmission of your data according to your post-mortem directives

The service is offered as a paid subscription (€1/month).

4. Account creation and security

Access conditions:

  • You must be of legal age (18 years minimum)
  • You must provide a valid email address
  • You must set a secure master password (minimum 12 characters)
  • Activation of two-factor authentication (2FA) is mandatory

Security:

  • You are solely responsible for the confidentiality of your credentials
  • Asfaly cannot recover your master password (end-to-end encryption)
  • In case of loss of your credentials, no access can be restored

5. User obligations

You agree to:

  • Use the service in a legal manner and in compliance with applicable laws
  • Not store illegal, dangerous, or prohibited content
  • Inform Asfaly of any unauthorized access to your account
  • Keep your account information up to date

6. Intellectual property

All elements of the Asfaly service (code, design, logos, texts, images) are the exclusive property of Asfaly or its partners and are protected by intellectual property laws.

You retain exclusive ownership of all data you store in your vault.

7. Liability and limitations

Asfaly commitments:

  • Implement all necessary security measures (AES-256-GCM encryption, mandatory 2FA, hosting in Switzerland)
  • Ensure service availability to the best of our ability
  • Respect the confidentiality of your data (end-to-end encryption)

Limitations:

  • Asfaly does not guarantee uninterrupted service availability
  • Asfaly cannot be held responsible for data loss due to user negligence (loss of master password, loss of 2FA device)
  • Asfaly does not guarantee data transmission if beneficiaries do not follow the procedure (death certificate, admin validation)

8. Duration and termination

Duration:
The service is subscribed for an indefinite period and can be terminated at any time.

Termination by user:
You can request deletion of your account at any time from Settings → My Personal Data → Delete my account.

Termination by Asfaly:
Asfaly reserves the right to suspend or terminate your account in case of:

  • Violation of these ToS
  • Fraudulent or illegal activity
  • Non-payment of subscription

9. Modification of ToS

Asfaly reserves the right to modify these ToS at any time. Modifications will take effect upon publication on the website. In case of significant changes, we will inform you by email.

10. Applicable law and jurisdiction

These ToS are governed by French law. In case of dispute, French courts will have sole jurisdiction.

11. Cookies and trackers

What is a cookie?
A cookie is a small text file placed on your device (computer, smartphone, tablet) when visiting a website. It allows storing information related to your browsing.

Cookies used by Asfaly:
Our website uses no advertising cookies, no analytics trackers, and no third-party services. Only strictly necessary technical cookies are used for:

  • Authentication: maintain your session when logged into your account
  • Security: protect your account against unauthorized access (session token)
  • Language preferences: remember the selected language for your navigation

Retention period:
These cookies are kept for a maximum of 12 months or until you log out of your account.

Cookie management:
You can configure your browser to accept or refuse cookies. However, if you refuse technical cookies, you will not be able to log in to your Asfaly account.
